BACKGROUND
Section 395.058 (c) (4) of the Texas Local Government Code requires the Capital Improvements Advisory Committee (CIAC) to file semi-annual reports with respect to the progress of the capital improvement plan and report to City Council any perceived inequities in implementing the plan or imposing impact fees.  Section 90-158 of the City's Code of Ordinances includes the same requirement.

Capital Recovery Fees, also known as Impact fees, can only be charged to new development and used in compliance with specific adopted plans to accommodate growth.  General maintenance and replacing old pipes are not acceptable uses of this fund.The attached report includes capital recovery balance reports for October 1, 2021 through March 31, 2022 and the CIAC minutes from May 25, 2022 during which the CIAC recommended acceptance of the report.

Active projects and associated expenses that are funded using Impact Fee Funds this period were as follows:

Water
  • Corbett Ground Storage Tank
    • Expenses FY22:  Professional services - $114,254.48
    • Status:  100% Design plans, specifications, and bid documents complete and delivered to City.  Project to bid next quarter.
  • City-wide Water Master Plan and Impact Fee Update Study
    • Expenses FY22:  Professional services - $2,877.37
    • Status:  Land Use Assumptions Technical Memo revisions underway.
Sewer
  • Woman Hollering Creek Wastewater Project
    • Expenses FY22:  Professional services - $7,415.06
    • Status:  Construction underway, submittals review process progressing, boring of casing beneath FM 1518 completed, project survey staking and clearing progressing.  First construction pay requisition expected next quarter.
  • City-wide Wastewater Master Plan and Impact Fee Update Study
    • Expenses FY22:  Professional services - $2,877.36
    • Status:  Wastewater model nearing completion 
Roadway
  • All Service Areas: Professional Services for work on amendment to Capital Improvement Plan to account for areas newly annexed to the City.  (Full cost of the amendment expended in two separate fiscal years has been spread equally across all four service areas.)
    • Expenses FY22: $11,371.00
    • Status:  Complete
  • Service Area 2:  Annual partial reimbursement of cost of Ripps Kreusler extension to Babcock Road 165, Ltd.
    • Amount Paid FY22:  $49,146.87
    • Amount Remaining to be Reimbursed:  $307,571.77 
GOAL
To accept the semi-annual reports on the revenue and expenditures relating to the water, wastewater, and roadway impact fees as filed by the CIAC.
COMMUNITY BENEFIT
To ensure compliance with State law and the City's Code of Ordinances and to ensure impact fees are being collected and spent appropriately.
SUMMARY OF RECOMMENDED ACTION
Approval of Resolution 22-R-61 accepting the Semi-annual report as filed by the CIAC.
FISCAL IMPACT
The report indicates the amounts collected and spent for water, wastewater, and roadway impact fees.
RECOMMENDATION
Staff recommends approval of Resolution 22-R-61 accepting the Semi-annual report as filed by the CIAC.
