BACKGROUND
The Municipal Court Judge and Prosecutor are normally paid per court session, with the Judge working 3 sessions per month typically and the Prosecutor working 2. The Judge is paid $950 per session and the Prosecutor is paid $850. Although Municipal Court days are not occurring as they normally have, the Municipal Court Office is still conducting business and to varying degrees the Judge and Prosecutor are still working for the City to deal with cases.

The Prosecutor sought clarification as to how he would be paid, prompting this item. Staff is recommending that the Prosecutor be paid at his proposed discounted hourly rate of $130 per hour. Given the anticipated volume of work for the Judge and the need for him to respond quickly on short notice staff is recommending he be paid the equivalent per month or his normal pay for 3 court sessions per month.
GOAL
Provide for compensation for the Judge and Prosecutor when Municipal Court is not occurring as it had been, given that their compensation was based on the number of court days they worked per month.

Allows for the ongoing provision of necessary services for the community.
SUMMARY OF RECOMMENDED ACTION
Staff recommends approval of Resolution 20-R-36 that establishes the basis of pay for the Judge and Prosecutor during the activation of the Public Heath and Emergency Disaster Declaration while Municipal Court is not meeting as usual.  
FISCAL IMPACT
This change is not anticipated to have a greater cost to the City.
RECOMMENDATION
Approval of Resolution 20-R-36.
