BACKGROUND
The City of Schertz and the San Antonio River Authority entered into an Interlocal Agreement (ILA) on March 24, 2015 for transportation, treatment and disposal of wastewater for Schertz' connections within SARA's Certificate of Convenience and Necessity (CCN).  Recently, it was discovered the ILA references processes that are not occurring as written.

For example, the ILA states the City shall make payments to SARA for connection fees.  In reality, SARA charges and collects connection fees rather than Schertz.  Both Schertz and SARA are in agreement to maintain this process and the proposed 5th amendment accurately reflects the current collection processes that have been mutually agreed upon by SARA and Schertz.  
GOAL
To have the City of Schertz City Council approve the 5th amendment to the San Antonio River Authority (SARA) and Schertz Interlocal agreement (ILA).
COMMUNITY BENEFIT
Through the San Antonio River Authority (SARA), the City of Schertz is able to provide wastewater services to its residents and commercial businesses and maintaining a current ILA helps to facilitate this professional relationship and ensure quality service.
SUMMARY OF RECOMMENDED ACTION
Staff recommends approval of Resolution 22-R-09 approving the 5th amendment to the existing Interlocal Agreement.
