BACKGROUND
In May or 2020, the City Council approved resolution 20-R-52 that authorized the City to enter into an agreement with ILF N-T Owner, LP, the developer of the Homestead residential development. The agreement was a reimbursement agreement associated with the acquisition of the easements needed for a sewer force main. The developer is constructing a sewer lift station and associated force main. The lift station will serve the Homestead project and surrounding properties. The developer had been trying to acquire the necessary easements and sought the City's assistance. The City agreed to help acquire the easements to provide necessary sewer service to the area and the developer agreed to pay the cost associated with the acquisition.
Multiple easements are needed from two property owners. The developer has reached agreement to acquire the needed easements from one of the property owner. 
The City has reached agreement with the other property owner for the 3 permanent easements and 3 temporary construction easements. Staff is seeking approval from City Council to purchase the needed easements. The developer will provide the funding to the City to acquire the easements.  
GOAL
Acquire three permanent easements and three temporary construction easements from Nolley Lake Properties, LLC.
COMMUNITY BENEFIT
The easements are necessary to provide for sewer service to an area of northern Schertz.
SUMMARY OF RECOMMENDED ACTION
Approval of Resolution 21-R-53 authorizing the City to acquire the necessary easements.
FISCAL IMPACT
There is no fiscal impact to the City as the developer of Homestead, ILF N-T Owner, LP will be reimbursing the City for the costs associated with acquiring the easements. The purchase price of the easements on the Nolley Lake Properties, LLC property is $115,000.
RECOMMENDATION
Approval of Resolution 21-R-53.
