BACKGROUND

The City of Schertz has received a petition for traffic extension for the gated community of Berry Creek. The Police Department patrols the gated communities; however, there are no agreements with the Berry Creek community to enforce traffic rules and laws related to the operation of motor vehicles on public roads.

Berry Creek is the second gated community to request traffic extension duties within the city. Berry Creek Homeowners Association Board unanimously voted (4-0) agreeing to the terms as stated in the petition.

The Texas Transportation Code (542.008) allows the following:

On a petition of 25 percent of the property owners residing in the subdivision or on the request of the governing body may extend by ordinance any traffic rules that apply to a road owned by the municipality, or by the county which the municipality is located, to the roads in the subdivision so that the roads of the subdivision are under the same traffic rules if the governing body of the municipality finds the ordinance in the interest of the municipality generally.

GOAL

The City of Schertz and Berry Creek (Homeowners Association) would enter into an agreement that would allow the Schertz Police Department to enforce traffic rules and laws for a safer community overall.

COMMUNITY BENEFIT

The community benefit for the Berry Creek subdivision residents is to provide a safer atmosphere using traffic enforcement as an effective tool to increase public safety by reducing traffic crashes, changes in driver behavior and compliance.

SUMMARY OF RECOMMENDED ACTION

Approving this Resolution by the City Council of the City of Schertz, Texas authorizing an agreement with the Berry Creek Homeowners Association for the purpose of traffic rules and laws.

FISCAL IMPACT

There is an associated cost for the replacement and installation of the signs within the Berry Creek subdivison, totaling $1,604.91.

RECOMMENDATION

Approval of Resoluton No. 21-R-88.
