City Council will hold its regularly scheduled meeting at 6:00 p.m., Tuesday, September 28, 2021, at the City Council Chambers. In lieu of attending the meeting in person, residents will have the opportunity to watch the meeting via live stream on the City’s YouTube Channel.

Hearing of Residents

This time is set aside for any person who wishes to address the City Council. Each person should fill out the speaker’s register prior to the meeting. Presentations should be limited to no more than 3 minutes.

 All remarks shall be addressed to the Council as a body, and not to any individual member thereof. Any person making personal, impertinent, or slanderous remarks while addressing the Council may be requested to leave the meeting.

Discussion by the Council of any item not on the agenda shall be limited to statements of specific factual information given in response to any inquiry, a recitation of existing policy in response to an inquiry, and/or a proposal to place the item on a future agenda. The presiding officer, during the Hearing of Residents portion of the agenda, will call on those persons who
have signed up to speak in the order they have registered.
 
Consent Agenda Items

The Consent Agenda is considered self-explanatory and will be enacted by the Council with one motion. There will be no separate discussion of these items unless they are removed from the Consent Agenda upon the request of the Mayor or a Councilmember.
 
1.   Minutes – Consideration and/or action regarding the approval of the minutes of the regular meeting of September 14, 2021. (B. Dennis)
 
2.   Resolution No. 21-R-100 — Consideration and/or action approving a Resolution by the City Council of the City of Schertz, Texas authorizing a Trail Easement Agreement with Cibolo Valley Baptist Church for a segment of the Great Northern Trail. (B. James/L. Shrum)
 
3.   Cancellation of the October 5, 2021, November 2, 2021, November 23, 2021, and December 28, 2021 Council Meetings as well as scheduling a Special Meeting on November 15, 2021 for the purpose of canvassing the results of the November 2, 2021 Election - Consideration and/or action canceling the October 5, 2021, November 2, 2021, November 23, 2021, and the December 28, 2021 City Council meetings due to the Texas Municipal League Conference in Houston, the City of Schertz Election, Thanksgiving week and the Christmas Holiday week; as well as scheduling a Special Meeting on November 15, 2021 for the purpose of canvassing the results of the November 2, 2021 Election. 4.   Resolution No. 21-R-105 - Consideration and/or action approving a Resolution by the City Council of the City of Schertz, Texas authorizing a contract with Intermountain Slurry Seal for the 2020 SPAM Resurfacing Project and authorizing the budget expenditures for the project. (B. James/J. Nowak)
 
5.   Resolution No. 21-R-101 - Consideration and/or action approving a Resolution by the City Council of the City of Schertz, Texas authorizing EMS debt revenue adjustments, Utility Billing debt revenue adjustments and Schertz Magazine debt revenue adjustments for certain inactive outstanding receivables and other matters in connection therewith. 6.   Resolution No. 21-R-110 - Consideration and/or action approving a Resolution by the City Council of the City of Schertz, Texas updating the Fee Schedule for FY2021-22, to include the Texas Alcoholic Beverage Commission (TABC) License/Permit Type: BG-Wine and Malt Beverage Retailer's Permit Fee and License/Permit Type BE- (Malt Beverage) Retail Dealer's On-Premise License. The two license/permit types have different fees depending on original and renewal applications, as well as to which county the business is located in. (M. Browne/B. Dennis/S. Edmondson)
 
7.   Resolution 21-R-99 - Consideration and/or action approving a Resolution by the City Council of the City of Schertz, Texas, authorizing expenditures in excess of $50,000 with T.F. Harper & Associates, a BuyBoard Purchasing Cooperative vendor, and authorizing a purchase totaling $110,917.19 for the Ashley Park Playscape and Pavilion. (B. James/L. Shrum)
 
8.   Resolution No. 21-R-88 - Consideration and/or action approving a Resolution by the City Council of the City of Schertz, Texas authorizing the City Manager to enter into an agreement with the Berry Creek Homeowners Association for the purpose of traffic extension/enforcement.  (C. 9.   Resolution No. 21-R-87 -  Consideration and/or action approving a Resolution by the City Council of the City of Schertz, Texas declaring certain Public Safety equipment to be surplus property, and authorizing a Donation Agreement governing the same to the City of Santa Clara, Texas.(C. Kelm./ M. Hansen/ M. Casas).
 
10.   Resolution No. 21-R-109 – Consideration and/or action approving a Resolution by the City Council of the City of Schertz, Texas authorizing the City Manager to sign a contract for mutual aid for fire emergency services with the Secretary of the Air Force, specifically for Joint Base San Antonio. (C. Kelm/K. Long)
 
11.   Resolution No. 21-R-53 - Consideration and/or action approving a Resolution by the City Council of the City of Schertz, Texas authorizing the acquisition of easements associated with the Homestead Lift Station Force Main. (M. Browne/B. James)

13.   Resolution 21-R-111 - Consideration and approval of a Resolution relating to establishing the City's intention to reimburse itself for the prior lawful expenditure of funds relating to constructing various City Improvements from the proceeds of tax-exempt obligations to be issued by the City for authorized purposes; authorizing other matters incident and related thereto; and providing an effective date. 14.   Resolution No. 21-R-106 – Consideration and/or action approving a Resolution by the City Council of the City of Schertz, Texas, authorizing a contract with Thalle Construction Co., Inc., relating to construction of the Woman Hollering Creek Wastewater Project and other matters in connection therewith.  (B. 15.   Resolution No. 21-R-107 - Consideration and/or action approving a Resolution by the City Council of the City of Schertz, Texas, authorizing a contract with AG|CM, Inc., for Owner's Representative Services related to the Woman Hollering Creek Wastewater Project.  (B. James/K. Woodlee)

The City Council for the City of Schertz reserves the right to adjourn into closed session at any time during the course of this meeting to discuss any of the matters listed above, as authorized by the Texas Open Meetings Act.

Closed Sessions Authorized: This agenda has been reviewed and approved by the City’s legal counsel and the presence of any subject in any Closed Session portion of the agenda constitutes a written interpretation of Texas Government Code Chapter 551 by legal counsel for the governmental body and constitutes an opinion by the attorney that the items discussed therein may be legally discussed in the closed portion of the meeting considering available opinions of a court of record and opinions of the Texas Attorney General known to the attorney. This provision has been added to this agenda with the intent to meet all elements necessary to satisfy Texas Government Code Chapter 551.144(c) and the meeting is conducted by all participants in reliance on this opinion.
